Selling a House in Lake Worth Beach: What Is Actually Different
Public information with the source next to it, not a paragraph that sounds local.
Much of what is now Lake Worth Beach was owned by Samuel and Fannie James, and the townsite was known as Jewel until Fannie James sold the core to the Palm Beach Farms Company in 1911. Platted as Lucerne, it took the name Lake Worth because a Florida town already had the first one, and a 1912 survey laid out 55 miles of streets and 7,000 residential lots. The median home dates from 1969 and 75% predate 1980. Six local historic districts, College Park, Old Lucerne, Northeast and Southeast Lucerne, South Palm Park and Old Town, need City approval before exterior work. We buy as the house sits.
Fewer than half of Lake Worth Beach's 15,493 occupied homes (46.0%) are lived in by their owners, so the seller is often a landlord with a tenant in place; the City requires every residential rental to hold a business/rental license and pass a Use & Occupancy inspection every three years. Owners stay: half moved in by 2013, and nearly four in ten owner households (38%) are headed by someone 65 or older. So the house can also reach us through an estate in probate at the Fifteenth Judicial Circuit; we work alongside the estate's attorney and pay that attorney at closing.
Before closing, the title company orders the City Clerk's lien search: $125 per folio number, or $250 for a two-day rush, results by email in seven to ten business days, covering special assessment liens, code enforcement liens, utility balances and outstanding building permits. Electricity and water come from the City's own utility, and the City holds a lien on every property its utility systems serve. Code cases go before a special magistrate, whose recorded fine is a lien on the land; with a sale under contract, the magistrate can hear a request for consideration for sale. We read all of it before the offer, and any balance shows as a line before you sign.

- Before closing in Lake Worth Beach
-
- The City Clerk's lien search covers special assessment liens, code enforcement liens, utility balances and outstanding building permits; a request gives the Palm Beach County Property Appraiser folio number, the legal description and the street address, costs $125 per folio number ($250 for rush service within 2 days), and results are sent by email in 7 to 10 business days. For property in unincorporated Palm Beach County where the City provides utilities only (folio numbers beginning with 00), the search is $85, or $170 rush. Source
- Under the City Code the City has liens on all lands or premises served by its utility systems, and a written request for an accounting of outstanding city liens must be submitted, with the fee, at least seven business days before the City's response. Source
- Lake Worth Beach Utilities describes itself as the community-owned provider of the City's electricity and water. Source
- The City is the provider of potable water within its water service area boundary, sends its wastewater to the East Central Regional Water Reclamation Facility in a joint effort with Palm Beach County, and plans capital projects to convert areas still on septic systems to City sanitary sewer. Source
- All properties used for residential rentals must have a City of Lake Worth Beach business/rental license, which includes an approved Use & Occupancy Inspection; Use & Occupancy Inspections are due every three years. Violations not corrected within a reasonable timeframe are scheduled for a Special Magistrate hearing. Source
- A special magistrate can fine up to $250 a day for a first violation and $500 a day for a repeat ($5,000 per violation if irreparable or irreversible); a recorded order is a lien on the land and on the violator's other property. A lien reduction hearing requires the property to be in total compliance, free of all debts to the City including taxes (shown by a City Clerk lien search), and the owner's other City properties free of active cases; after documented expenses, the magistrate cannot reduce a lien below 10% of the remaining balance unless the property is owner-occupied residential. Source
- With a valid contract for sale, the special magistrate may hear a request for consideration for sale if the property is secured, the landscaping is not overgrown, trash and debris are removed and a compliance schedule is filed, one request per proposed purchaser; the city manager can also reduce a lien recorded less than 18 months earlier when the property will be sold before the next hearing and the application arrives at least five business days before closing. A reduced lien not timely paid reverts to its original amount. Source
- Unpaid monthly code reinspection assessments are levied as a non-ad valorem assessment equal in rank and dignity with a lien for ad valorem taxes, and may be certified to the tax collector for collection on the property tax bill. Source
- Owners of property that is vacant, unimproved, without an active utility account, or in default or mortgage foreclosure must register it with the City's Code Compliance Division. Source
- A Certificate of Appropriateness is required before exterior work begins and before a building permit can be issued for a property in one of the City's six local historic districts or for an individually designated landmark. Source
- The first two digits of a Palm Beach County parcel control number are the municipality code: 38 for Lake Worth Beach. Source

What does the City of Lake Worth Beach lien search cover?
The City Clerk's search covers special assessment liens, code enforcement liens, utility balances and outstanding building permits. It costs $125 per folio number, or $250 for a rush within two days, and results come by email in seven to ten business days. Since the City also sells the electricity and water, an unpaid utility account shows up here. We order it early, read it before the offer, and any balance shows as a line before you sign.
-
My Lake Worth Beach house has a code lien. Can you still buy it?
Yes. A special magistrate's recorded fine order is a lien on the property, and once there is a contract for sale the magistrate can hear a request for consideration for sale, if the house is secured, the yard is not overgrown, the trash is gone and a compliance schedule is filed. For a lien recorded in the last 18 months, the city manager can also consider a reduction before a closing. We buy with the lien attached and work it with the City ourselves. We are buyers, not lawyers, and we give no legal advice.
-
Do you buy rental houses in Lake Worth Beach with tenants still in them?
Yes, and here that is a usual call: more than half of the city's occupied homes are rented. The City requires every residential rental to hold a business/rental license with a Use & Occupancy inspection every three years, and we read the City's lien search before the offer. You do not have to evict anyone for us; after closing that is ours. Tell us the real tenant situation up front so the number holds.
-
My house is in a historic district and needs work. Can you buy it as it sits?
Yes. The median Lake Worth Beach home dates from 1969 and 75% were built before 1980, so an original roof, old wiring or worn windows are what we expect. In College Park, Old Lucerne, Northeast and Southeast Lucerne or South Palm Park, exterior work needs a Certificate of Appropriateness before the permit is issued; after closing, that approval is ours to get. We walk the house, show you the comps and repair numbers we used, and you pick the closing date.
