Selling a House in Wellington: What Is Actually Different
Public information with the source next to it, not a paragraph that sounds local.
In 1951 C. Oliver Wellington decided to buy the land that became his Flying Cow Ranch, and in 1953 the State created the Acme Improvement District to drain it for farming. Incorporated on December 31, 1995, the Village covers more than 45 square miles of land, and its charter makes protecting the equestrian community a priority. Most houses came after 1980: the median home dates from 1995, and only about one in eight predates 1980. The Village's own housing study says homes past 20 years may need work on air conditioning, asphalt roofs, appliances and fencing, and we buy the house as it sits.
Owners live in about three of every four occupied homes, the typical owner arrived in 2012, and one in three owner households is headed by someone 65 or older. So a sale may follow a move on a deadline, an estate in probate at the Fifteenth Judicial Circuit, or payments that slipped; we work alongside the estate's attorney and pay that attorney at closing. About one occupied home in four is rented, so some sellers have a tenant in place.
A special magistrate appointed by the Village Council hears code cases. After compliance the magistrate can reduce a fine only until its order is recorded; from then on it is a lien on the land that only the Council, or staff under its 2021 lien reduction policy, can compromise. Under that policy the Code Compliance Manager can approve a stipulated settlement with the buyer of a house being sold, who takes on the violations and fixes them after closing. The Village's rental license does not pass to a buyer, and the seller notifies the Village within 24 hours of the sale. We order the lien report and read it before the offer, and any balance shows as a line before you sign.

- A fine ordered by the special magistrate becomes a lien on the land, and on any other property the violator owns, once a certified copy of the order is recorded in the public records. Source
- After compliance, the special magistrate can reduce a fine only until the order imposing it is recorded; after that, only the Village Council, or staff where the Council has delegated it by policy, can compromise the lien. Source
- Under the Village Council's lien reduction policy, the Code Compliance Manager may approve a stipulated settlement with a potential buyer when a property with a code lien is being sold: the buyer accepts responsibility for the violations and gets time to correct them after taking ownership, and the Village releases the lien once the negotiated settlement is paid. - A rental dwelling unit license cannot be transferred to a new owner: the owner gives the Village written notice within 24 hours of transferring a licensed unit, the new owner applies for a new license within 30 days, and an inspection is required after the transfer. Source

Do you buy in Palm Beach Polo, Sugar Pond Manor and Saddle Trail Park?
Yes, anywhere inside the Village, from Palm Beach Polo and Sugar Pond Manor to Paddock Park, Palm Beach Point and Palm Beach Little Ranches, and in unincorporated Palm Beach County too. To see which side of the line a house is on, look up its parcel control number on the Palm Beach County Property Appraiser's site: 73 at the start means Wellington, 00 means unincorporated county. We walk the house, we show you the comps and repair numbers we used, and you pick the closing date.

My Wellington house has a code fine or a code lien. Can you still buy it?
Yes. Here a fine becomes a lien once the special magistrate's order is recorded, and the Village's 2021 lien reduction policy lets the Code Compliance Manager approve a stipulated settlement with the buyer of a house being sold, who takes on the violations and fixes them after closing. We read the lien report before the offer, and any balance shows as a line before you sign.

I rent my Wellington house out. Do I have to get the tenant out before I sell?
No. You do not have to evict anyone for us; after closing that is ours. The Village's rental license does not transfer with the house: you notify the Village in writing within 24 hours of the sale, and applying for a new license within 30 days, with the inspection that follows the transfer, is on us as the new owner.

I inherited my parents' house in Wellington. Can you buy it while probate is open?
Yes. One in three owner households in Wellington is headed by someone 65 or older, and Palm Beach County estates are probated in the Fifteenth Judicial Circuit; we work alongside the estate's attorney and pay that attorney at closing. We are buyers, not lawyers, and we give no legal advice.
