Selling a House in Deerfield Beach: What Is Actually Different

Public information with the source next to it, not a paragraph that sounds local.

The Town of Deerfield, incorporated on June 11, 1925, became Deerfield Beach in 1939 and a city in 1951. It covers about 16 square miles of northeast Broward, roughly from Florida's Turnpike to the Atlantic between the Palm Beach County line and Sample Road, and the City's land-use plan calls it mostly built out. The median home was built in 1978 and 59% predate 1980, so most are over 45 years old. At that age we expect the roof, plumbing or electrical panel to need work, and we price the house with that work undone.

Owners live in 63.9% of the City's 36,441 occupied homes, the typical owner has been there since 2013, and 43% of owner households are headed by someone 65 or older. So a sale here may run through an estate in probate at the Seventeenth Judicial Circuit; we work alongside the estate's attorney and pay that attorney at closing. Renters occupy the other 36%, so some sellers are landlords with a tenant in the house; others are relocating on a deadline or behind on payments.

The City's lien searches go through Lien Library, and the City Code makes unpaid water and sewer bills a lien equal in rank with property taxes. CAP Government handles the City's permits, inspections and permit close-outs; permit status is online. Code cases go to a Special Magistrate, fines are recorded as a claim of lien, and an owner can ask the Magistrate for relief or a reduction. If the title search turns up a code lien from another property of the same owner, the City has a Partial Release of Lien request, with a $250 deposit per folio. We order and read all of it before the offer, and any balance shows as a line before you sign.

Before closing in Deerfield Beach
  • Lien searches go through Lien Library, the company the City's Code Compliance page links for searching, managing and paying property liens. Source
  • CAP Government performs the City's Florida Building Code duties, including permit applications, plan approvals, inspections and permit close-out; permit status is online through the City's Online Permit Status portal, and building records are requested through the City's public records portal. Source
  • Code cases are heard by the City's code enforcement Special Magistrate. If a property is sold after a case is served but before its hearing, the seller must disclose the case to the buyer in writing, with copies of the notices, and file a notice of the transfer with the code enforcement official within five days after it. Source
  • Code fines are imposed by an Order of Imposition of Fine and Claim of Lien that the City records, and an owner can apply to the Magistrate for relief or a fine reduction; the City's form says an attorney is not necessary. Source
  • When a title search during a sale finds liens placed on properties owned by the same person attached to a property with no violations, the City takes a Partial Release of Lien request: a $250 non-refundable deposit per folio plus a Lien Library lien search from the last 30 days, and the Code Compliance Manager approves and sets the amount or denies the request. Straight answers

Questions Sellers Ask Us

The ones people ask about this, answered straight.

  • Do you buy in Old Deerfield, The Cove, Deer Creek and the rest of Deerfield Beach?

Yes, anywhere inside the City limits, including Crystal Heights, Independence Bay, Carver Heights and Tallman Pines. The median home here was built in 1978 and 59% predate 1980, so we expect the roof, the plumbing or the panel to need work and we buy the house as it sits. We walk the house, show you the comps and repair numbers we used, and you pick the closing date.

  • There is a code case or a code lien on my Deerfield Beach house. Will you still buy it?

Yes: we buy with the case or the lien attached, read the City's lien search before the offer, and any balance shows as a line before you sign. Code cases here go to a Special Magistrate, fines are recorded as a claim of lien, and an owner can ask the Magistrate for relief or a fine reduction; if the house sells before a served case is heard, the City Code has the seller disclose the case to the buyer in writing and notify the code official within five days after the transfer. We are buyers, not lawyers, and we give no legal advice.

  • Which City records does the title company pull for a Deerfield Beach closing?

The City's lien search, which goes through Lien Library, and the permit record: CAP Government handles the City's permits and permit close-outs, and permit status is online. Unpaid water and sewer bills are a lien equal in rank with property taxes under the City Code, and if the search shows a code lien from another property of the same owner, the City has a Partial Release of Lien request with a $250 non-refundable deposit per folio and a Lien Library report from the last 30 days. We order the search early and read it before the offer, and any balance shows as a line before you sign.

  • I inherited a house in Deerfield Beach. Can you buy it while probate is open?

Yes. In Deerfield Beach 43% of owner households are headed by someone 65 or older, and when one of those homes goes through probate, the case is in Broward's Seventeenth Judicial Circuit; we work alongside the estate's attorney and pay that attorney at closing. We are buyers, not lawyers, and we give no legal advice.
