What's specific here

Selling a House in Weston: What Is Actually Different

Public information with the source next to it, not a paragraph that sounds local.

Weston is a master-planned city in southwestern Broward County, bordering the Everglades. Arvida's development, first called Indian Trace, finished its first homes in Windmill Ranch and Country Isles in 1984, and residents voted to incorporate on September 3, 1996; Bonaventure voted to join in 1997. With a median home from 1995 and only 7% built before 1980, the house that reaches us is rarely old. An association usually comes with it: the City says most residences sit in a private development whose homeowners' association maintains the roads and landscaping.

Nearly three of every four of Weston's 21,773 occupied homes (73.0%) are lived in by their owners. Half of those owners moved in by 2012, and just over one in five owner households (22%) is headed by someone 65 or older. What brings an owner to us here is usually a deadline, not an estate: a move that cannot wait, or payments that slipped. When an estate is involved, its probate case is in Broward's Seventeenth Judicial Circuit; we work alongside the estate's attorney and pay that attorney at closing.

For the title company, the City runs an estoppel and lien search through its Accela portal: $250 per parcel, five business days. It covers code violations, code liens and open permits everywhere, plus water and sewer for Indian Trace properties; in Bonaventure that information comes from the City of Sunrise. Building records for a house built before 1997, as more than half of Weston's homes were, are requested from the Broward County Records Division. Uncorrected code violations are heard by a Special Magistrate at City Hall, and a recorded fine order is a lien that the City Manager, after consulting the City Attorney, may settle once the violation is fixed. We order it, read it before the offer, and any balance shows as a line before you sign.

Before closing in Weston
  • The City's estoppel and lien search costs $250 per inquiry, one application per parcel, with 5 business days allowed for processing; it is requested and paid by credit card through the City's Accela portal, and staff still perform the search by hand. Source
  • For Indian Trace properties it covers water and sewer, pending code violations and code enforcement liens, and open permits; for Bonaventure properties it covers pending code violations, code enforcement liens and open permits, and water and sewer information comes from the City of Sunrise. Source
  • Building records for structures built before 1997 are requested from the Broward County Records Division; for 1997 to 2005 the County gives the permit number and the City's Building Code Services Department provides the copies; after 2005 the City's department locates them. Source
  • The Special Magistrate can fine up to $1,000 a day for each day a violation continues past the compliance date ($5,000 a day for a repeat violation), and a certified copy of the fine order, once recorded in Broward County's public records, is a lien on the property. Source
  • The City Manager, after consulting the City Attorney, may negotiate and settle Special Magistrate fines and liens once the violation has been complied with; the Special Magistrate is advised of every settlement. Source

Straight answers

Questions Sellers Ask Us

The ones people ask about this, answered straight.

  • Will you buy in a Weston HOA community like Bonaventure, Savanna or Weston Hills Country Club?

Yes. Every neighborhood inside the City of Weston is in our area, from Bonaventure and Country Isles to Savanna, Emerald Estates and Isles at Weston. Most homes here are in an HOA community, so we expect one: we walk the house, show you the comps and repair numbers we used, and any HOA balance shows as a line before you sign.

  • How does the City of Weston's lien search work, and what does it cover?

It is requested online through the City's Accela portal and paid by credit card, $250 per parcel, and the City asks for five business days. For an Indian Trace property it reports water and sewer, pending code violations and code enforcement liens, and open permits; for a Bonaventure property it reports the code matters and open permits, and the water and sewer information comes from the City of Sunrise. We order it ourselves, read it before the offer, and any balance shows as a line before you sign.

  • There's an unpaid code fine on my Weston house. Will that stop the sale?

Not a sale to us. In Weston, a Special Magistrate's fine order recorded with Broward County is a lien on the property, and once the violation is corrected the City Manager, after consulting the City Attorney, may negotiate and settle it. We buy the house with the lien attached and read the City's lien search before we make the offer; any balance shows as a line before you sign. We are buyers, not lawyers, and we give no legal advice.

  • I'm relocating and behind on the mortgage. Can you buy my Weston house on my timeline?

Yes. You pick the closing date, and the relocation plan covers movers and a rental agent for your next place. We bring in foreclosure attorneys and handle the bank ourselves, and the payoff, plus any HOA balance, shows as a line before you sign. We are buyers, not lawyers, and we give no legal advice.
