Selling a House in Ocean Ridge: What Is Actually Different

Public information with the source next to it, not a paragraph that sounds local.

Ocean Ridge was created by the Florida Legislature in 1931 as the Town of Boynton Beach, after a tax dispute over beach properties, and a 1937 contest picked its present name. Its roughly 635 acres sit entirely on the barrier island, from the Boynton Inlet to Briny Breezes, and the Town permits no commercial or industrial uses. The median home was built in 1974 and 62% predate 1980, so the house that reaches us often still has its original roof, windows or wiring.

More than four of every five of Ocean Ridge's 852 occupied homes (83.0%) are lived in by their owners. Half of those owners moved in by 2012, and three in five owner households (61%) are headed by someone 65 or older. So the house often reaches us through an estate in probate at the Fifteenth Judicial Circuit, or from an owner ready to move rather than renovate. We work alongside the estate's attorney and pay that attorney at closing.

The title company orders the Town Clerk's lien search: $100, an estimated 7 to 14 days, covering code cases, open or expired permits, special assessments and garbage billing. Water comes from the City of Boynton Beach; there is no central sewer, so houses use septic tanks. A recorded special magistrate fine is a lien only the Town Commission can settle for less, once the property complies. In flood hazard areas, two years of improvements reaching half the building's value must meet flood construction rules. We read all of it before the offer, and any balance shows as a line before you sign.

Before closing in Ocean Ridge
  • Lien searches are requested from the Town Clerk on the Town's request form: $100, processed in the order received, with an estimated turnaround of approximately 7 to 14 days; the fee can be paid online through BSA Online. Source
  • The Town's lien search covers, among other things, open or pending code enforcement cases, nuisance abatements, unsafe structures, special assessments or notations, open and expired permits, administratively closed permits, open building permit fees, rental registration, and garbage and trash and alarm monitoring billing. Source
  • Permit applications, inspection scheduling and Building Department fees run through the Town's BS&A Online portal, which also searches the Town's permit and invoice records by address, name or parcel number. Source
  • Uncorrected code cases go to a special magistrate, who can fine up to $250 a day ($500 a day for a repeat violation); a recorded fine order is a lien on the land and on the violator's other property. The magistrate can reduce a fine only before its order is recorded; after that, only the Town Commission can release it for less than full payment, and only once taxes, assessments and Town charges are paid, the owner owes the Town nothing and the owner's property in Town fully complies with the code. Source
  • The Town buys its water from the City of Boynton Beach, which bills residents for their use, while the Town owns and maintains the water lines; there is no central wastewater treatment, so about 49% of dwelling units, in 12 multifamily projects, are served by package plants and the rest by septic tanks. Source
  • In the Town's flood hazard areas, repairs and improvements are added up over a two-year period; when their cumulative cost reaches 50% of the building's market value the work is a substantial improvement and must meet the flood resistant construction requirements of the Florida Building Code and the Town's floodplain ordinance. Source
  • The Town adopts the state's 1997 coastal construction control line: nothing may be built, excavated or regraded seaward of it without a permit from the Florida Department of Environmental Protection, and the Town issues no building permit until that state permit is in hand. Source

Questions Sellers Ask Us

The ones people ask about this, answered straight.

  • What does the Town of Ocean Ridge lien search cover?

The Town Clerk runs it: $100, processed in the order received, with an estimated turnaround of 7 to 14 days. It reports open or pending code cases, nuisance abatements, unsafe structures, special assessments, open, expired and administratively closed permits, open permit fees, rental registration, and garbage and alarm monitoring billing. We order it ourselves, read it before the offer, and any balance shows as a line before you sign.

  • There's a code fine on my Ocean Ridge house. Can you still buy it?

Yes. In Ocean Ridge a special magistrate's fine order, once recorded, is a lien on the property. Before it is recorded the magistrate can reduce it; after that only the Town Commission can release it for less, once the property complies and the Town is owed nothing else. We buy with the violations attached and work them with the Town ourselves, and any balance shows as a line before you sign. We are buyers, not lawyers, and we give no legal advice.

  • My Ocean Ridge house needs a lot of work. Can you buy it as it sits?

Yes. The median Ocean Ridge home dates from 1974 and 62% were built before 1980, so an older house is what we expect. In the Town's flood hazard areas, improvements are added up over two years, and once they reach half the building's market value the work must meet flood resistant construction rules; the permits for any work after closing are ours to get. We walk the house, show you the comps and repair numbers we used, and you pick the closing date.

  • I inherited my parents' house in Ocean Ridge. Can you buy it while probate is open?

Yes. Three in five owner households in Ocean Ridge are headed by someone 65 or older, and Palm Beach County estates are probated in the Fifteenth Judicial Circuit. We work alongside the estate's attorney and pay that attorney at closing. Your attorney runs the estate. We are buyers, not lawyers, and we give no legal advice.
